GENERAL TERMS

These Terms and Conditions ("Terms") constitute a legally binding agreement between HeartMates HomeCare LLC, a Florida Limited Liability Company ("HeartMates," "we," "us," or "our"), and any person who uses our services or engages in employment with our company ("you," "your," or "user"). These Terms are governed by and construed in accordance with the laws of the State of Florida.

COMPLIANCE WITH FLORIDA LAW

HeartMates HomeCare LLC operates in compliance with Florida Statutes Chapter 400, Part III, and all other applicable Florida and federal laws. Our services are provided in accordance with Florida's regulations governing homemaker and companionship services.

SERVICE TERMS

Service ProvisionHeartMates HomeCare LLC provides homemaker and companionship services in Florida. Our services are provided in accordance with Florida law and professional standards. We maintain all necessary licenses and registrations required by Florida law to provide these services.

Service Standards
All services are provided in accordance with Florida's professional standards and requirements. Our employees are properly screened and trained as required by Florida law, including compliance with background screening requirements under Florida Statutes § 400.512.

SMS COMMUNICATIONS TERMS

Authorization and Scope
Our SMS communications program operates under Florida and federal telecommunications laws. By providing your consent to receive SMS messages from HeartMates HomeCare LLC, you acknowledge and agree to the following terms:

Message Purpose and Frequency: SMS communications are limited to business-related messages, including but not limited to scheduling, service updates, and employment matters. Message frequency will not exceed three (3) messages per week except in emergencies as defined by Florida law.

Consent: Your consent to receive SMS messages is voluntary and may be revoked at any time. Consent to receive SMS messages is not a condition of employment or service provision.

Rates and Charges: Standard message and data rates may apply to all SMS communications. HeartMates HomeCare LLC is not responsible for any charges you may incur from your wireless carrier.

Privacy Protection: Your SMS consent and contact information are protected under Florida law and will not be shared with third parties for marketing purposes.

Opt-Out Instructions: You may opt out of SMS communications at any time by replying "STOP" to any message. After opting out, you will receive one final message confirming your opt-out status.

EMPLOYMENT TERMS

Employment Relationship
Employment with HeartMates HomeCare LLC is governed by Florida employment law. All employment is at-will, as defined by Florida law, unless explicitly modified by a written agreement signed by an authorized company officer.

Professional Standards
Employees must maintain all necessary certifications and comply with all applicable Florida laws and regulations governing homemaker and companionship services.

LIMITATION OF LIABILITY

To the fullest extent permitted by Florida law, HeartMates HomeCare LLC's liability shall be limited. This limitation of liability shall be construed in accordance with Florida Statutes and applicable case law.

GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the State of Florida. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Florida.

MODIFICATIONS TO TERMS

HeartMates HomeCare LLC reserves the right to modify these Terms in accordance with Florida law. Any modifications will be effective upon posting of the updated Terms. Your continued use of our services after such modifications constitutes acceptance of the modified Terms.

SEVERABILITY

If any provision of these Terms is found to be unenforceable under Florida law, the remaining provisions shall continue in full force and effect.
